Property rights are important institutions that influence economic performance and reflect the historical, cultural, and political realities of particular societies. Drawing on a variety of concepts from legal and economic studies, a framework for explaining the origin and evolution of property rights is developed and applied to the specific case of changing ground water rights in Nebraska. The Nebraska case is an interesting example of reliance on local control in regulating water use. Despite the importance of local initiatives in ground (...) water management, this case also illustrates the need for external support from the judicial and legislative systems. The evolution of ground water property rights in Nebraska, as in other parts of the United States, has been conditioned by historical circumstances and changing values and attitudes as well as by economic and political forces. How do rational minds make contact with the world? The empiricist tradition sees a gap between mind and world, and takes sensory experience, fallible as it is, to provide our only bridge across that gap. In its crudest form, for example, the traditional idea is that our minds consult an inner realm of sensory experience, which provides us with evidence about the nature of external reality. Notoriously, however, it turns out to be far from clear that there is any viable (...) conception of experience which allows it to do the job. The original problem is to show that thought is rationally constrained by external reality. If sensory experience is to provide the solution--in particular, if it is to provide the answer to sceptical challenges--it must therefore meet two criteria. First, it must itself be `receptive'--i.e., appropriately constrained by external reality. Second, it must be the kind of thing that can enter into a logical or rational relationship with belief--it must already be `conceptual,' in other words. In arguing against the idea that anything could serve both roles, Wilfred Sellars termed this conception of experience "the Myth of the Given.". (shrink)

We argue that a phenomenological approach to social space, as well as its relation to embodiment and affectivity, is crucial for understanding how the social world shows up as social in the first place—that is, as affording different forms of sharing, connection, and relatedness. We explore this idea by considering two cases where social space is experientially disrupted: Moebius Syndrome and schizophrenia. We show how this altered sense of social space emerges from subtle disruptions of embodiment and affectivity characteristic of (...) these conditions. These disruptions are instructive, we suggest, in that they highlight the foundational role that body and affect play in organizing social space—the lived context in which we first encounter one another as social agents. THE FIRST EXHAUSTIVELY SCIENTIFIC, speculative inquiry into the notion and nature of essence in the Western philosophical tradition is found in Aristotle's Metaphysics. In contrast to the earlier Greek philosophers and Plato, after considering the problem of being and change Aristotle reached the conclusion that the essential identity of material phenomena, or ousia, is an immanent and inseparable quality that forms the identity of each particular phenomenon. In Aristotle's concept, however, which constitutes the original form of phenomenal realism, ousia is (...) not "it"-self some-thing or some it. For though its presence may certainly be speculatively implied, "it" is not. Following Aristotle, though, and for reasons extraneous to the theme of this present article, the speculative inquiry into the nature of essence and phenomenality deviated from the orientation that Aristotle initially imputed to that study, evolving in a philosophical milieu whose theoretical propensity was predominantly transcendental. This article, then, focuses on the problematic of essential identity in the Western transcendental tradition, and, more particularly, seeks to contrast and compare the essence of the transcendental philosophers against the ousia of Aristotle's metaphysic. Making Worlds brings together thirty-one distinguished feminist activists, artists, and scholars to address a series of questions that resonate with increasing urgency in our current global environment: How is space imagined, represented, arranged, and distributed? What are the lived consequences of these configurations? And how are these questions affected by gender and other socially constructed categories of "difference"—race, ethnicity, sexuality, class, nationality? How are the symbolic formations of place and space marked by cultural ideologies that carry across into the places (...) and spaces we inhabit, the boundaries and institutions we maintain? In recent years these questions have occasioned intensifying debates, but they have seldom extended beyond the boundaries of individual academic disciplines or crossed the divide that has traditionally separated the academy from the "outside" world. Making Worlds both questions and traverses those divisions by combining personal essays, activist political rhetoric, oral history, poetry, iconography, and performance art with interdisciplinary academic discourses.
